The MCA has come up with the latest notification of Companies Winding Up and the same has been named as the Companies (Winding Up) Rules, 2020. This rule shall come into force from 1st April, 2020. These rules shall apply for winding up of the company under Companies Act, 2013.
Now one has to file Form WIN-1 and WIN-2 at the place of Form STK-2, as the case may be, with such variations as the circumstances may require, and shall be presented in triplicate.
Some affidavits have to be filed in Form WIN-3, in case the petition is presented by the Director, Secretary or any other authorized person thereof. Form WIN-1 to WIN- 95 is applicable for winding up under Companies Act, 2013.
